Advocates want Karnataka CJ not to preside over the bench

Ahead of the Supreme Court collegium meeting in Delhi tomorrow, troubles for Karnataka chief justice PD Dinakaran grew with the advocates here urging him to keep away from work and threatening further action if he did not not comply with their request.

The Advocates Association of Bangalore (AAB) held an emergent Special General Body meeting in the wake of allegations against Dinakaran and urged him not not to preside over the bench till he is cleared of the allegations of amassing of wealth levelled against him.
      
Justice Dinakaran has denied these allegations during a meeting with the chief justice of India KG Balakrishnan during a meeting in Delhi last week.

"If the chief justice does not accede to our request of not presiding over the bench, we will call another Special General Body meeting to decide the future course of action," AAB president K N Puttegowda told reporters after the meeting.

In a resolution, the AAB said "during the tenure of the current chief justice, if any wrong decision has been taken, it will be listed. The same would be forwarded to prime minister Manmohan Singh, Union law minister M Veerappa Moily and chief justice of India KG Balakrishnan".

Chief justice Dinakaran, who heard a few cases this morning, however, was unavailable for comment over the Advocates Association's decisions.

Allegations including that of acquisition of land over and above the land ceiling laws in Tamil Nadu, have been levelled against justice Dinakaran after reports appeared about the Supreme Court collegium clearing his name for elevation to the apex court bench.

Following severe objections by legal luminaries, who had demanded a review of the decision to elevate justice Dinakaran, the meeting of the collegium has been convened by the CJI tomorrow to discuss the issue.

AAB general secretary Rajanna said "it (resolution) should serve as a lesson to other judges to ensure transparency".

Today's marathon meeting of advocates also passed a resolution asking all judges of the state High Court to "disclose" their assets immediately.

Justice DV Shylendra Kumar of the Karnataka High Court, who had stirred up a hornet's nest by penning an article in an English daily over making judges' assets public, was the first judge to file a statement of his assets and liabilities voluntarily and even displayed the details on his website.

The court which closes for "mahalaya amavasya", a state government holiday tomorrow, will have Dussehra festival vacation from September 22 and reopen on October five.

Meanwhile, a Tamil Nadu Farmers Association today alleged that a some VIPs, including the judge, had grabbed government's waste land in Kaverirajapuram in Tiruvallur district.
