Complaint filed in Lokayukta court against BS Yeddyurappa, Murugesh R Nirani

The managing director of Pasha Space International Pvt Ltd, Alam Pasha, filed a corruption case in the Lokayukta court against former industries minister Murugesh R Nirani, former chief minister BS Yeddyurappa, former principal secretary VP Baligar and former managing director of Karnataka Udyog Mitra Shivaswamy on Thursday.

It was submitted that at the Global Investors’ Meet organised by the state government, a project proposal of Rs600 crore to build and establish “value homes for middle and lower income group” and generating employment to 500 people were discussed in detail by the high-power committee comprising the then chief minister Yeddyurappa, Nirani and other senior officials after considering the proposal in the 23rd state high level clearance committee meeting held in 2010.

Pasha, in the complaint, said the proposal was approved by the government and it directed the Karnataka Industrial Areas Development Board (KIADB) to allot 26 acres of land at Devanahalli Industrial Area.

According to the complaint filed in the Lokayukta court, Pasha submitted an application to the KIADB along with the requisite earnest money deposit. Pasha received a government order dated March 11, 2011, stating that in the 24th state high-level clearance committee meeting held on January 24, 2011, the proposal of the company was discussed by the committee and approved for withdrawing the original government order with immediate effect, and also instructed KIADB not to allot land to Pasha Space International Pvt Ltd.

The complainant said the accused herein have ceased to hold the office, which they had abused. “Hence, the sanction to prosecute them under Section 19 of the Prevention of  Corruption Act or under Section 197 of Code of Criminal Procedure is necessary. The Constitution Bench of the Supreme Court in the case of AR Antulay vs Ramdas Sriniwas Nayak and others reported in 1984 has held that the sanction to prosecute a public servant is not required when the said public servant ceased to hold the office, which he had abused. The said law has been reiterated in the case of Abhay Singh Cautala reported in 2011,” the complaint said.
