Supreme Court asks schools to charge only provisional fees

While the court also asked the state government to consult parents associations and the schools to fix the exemption limit

The Supreme Court on Thursday made it clear that the schools shall only charge provisional fees as of now. The bench which was hearing a petition filed by schools challenging the constitutional validity of the Act, asked the state government to reconstitute the Fee Fixation Committees and revisional authority under the Act, headed by retired high court judges. While the court also asked the state government to consult parents associations and the schools to fix the exemption limit, on another hand, it has also asked the state government to not take any coercive steps until then.

The order read: After such limit is fixed, the state shall scrutinize the proposals and the accounts submitted by the various schools including the petitioner schools and shall fix the fee. Preferably, the state may create categories of fee structure along with the facilities made available by the schools fro easy determination of the fees chargeable by the schools. Schools shall declare their fee structure only on a provisional basis and shall not collect anything more than the provisional fees."

Commenting on the judgment, Manan Chokshi, Executive Director, Udgam School for Children and spokesperson of Association of Progressive Schools (AoPS) said, "It is a very balanced order by the Supreme court as the court is trying to bring objectivity in the determination of fees. It is a win-win situation for the government and parents. Until now, parents had no says in the entire process. With this order, at least parents will have some representation in fixing exemption limit. The schools are allowed to charge provisional fees too." Naresh Shah, president, All Gujarat Parents Association said, "It is a win for us as the old FRC committee has been asked to be reconstituted and we will be heard for fixing exemption."
