A CBI team returned empty-handed from the Nadiad Sub-jail on Monday when it failed to get the custody of suspended IPS officer Abhay Chudasama — one of the prime accused in the Sohrabuddin fake encounter case. Condemning the prison department’s act, sources in the CBI said it should be treated as contempt of court, which had ordered that Chudasama be shifted to the Taloja jail in Mumbai.

The CBI team from Mumbai reached the Nadiad Sub-jail around 8 am on Monday and showed the order of a Mumbai court to hand over the custody of Chudasama. But, even after a long wait, the CBI officers did not get Chudasama’s custody on medical grounds.

Talking to dna, Nadiad sub-jail superintendent VJ Chauhan said, “He is already undergoing treatment at the Ahmedabad Civil Hospital and needs further medication,” said Chauhan, adding that Chudasama would be sent to the Civil Hospital on Tuesday and then handed over to the CBI if found fit.

Despite several attempts, additional director-general of police, prison department, PC Thakur, was not available for comment. CBI sources said the act of the Nadiad Sub-jail staff was nothing short of contempt of court and the agency would move court soon.

A few days ago, a Mumbai court had issued an order based on a CBI application to shift Chudasama to the Mumbai jail as the trail of the Sohrabuddin case has been transferred there. Chudasama had earlier requested the court to not transfer him to Mumbai on health grounds.
