Satellite gang rape: Gujarat High Court to hear ‘fair probe’ plea on December 10

The Gujarat High Court on Friday adjourned the hearing on a plea filed by the father of the victim in the infamous Satellite gang rape case for a fair probe to December 10. The single judge bench of Justice RP Dholaria adjourned the hearing after the counsel of the state government cited unavailability of public prosecutor Mitesh Amin.

The court had earlier instructed the Ahmedabad police commissioner to submit a report regarding the investigation carried out in the case so far after filing of the FIR in Satellite police station on June 28. Although investigating officer (IO) Panna Momaya was present in the court, the report was not submitted and is likely to be submitted on December 10.

Interestingly, during the pendency of the matter in the high court when the police was supposed to provide details of the investigation carried out so far along with the evidence collected, the police on Thursday submitted a closure report before the lower court completely turning the table on the victim. In the closure report, it has been claimed that that the victim has fabricated the whole story and there is no evidence to corroborate the sequence of events as told by her. The police have also given a clean chit to the accused Rushabh Maru, Gaurav Dalmia, and Yamini Nair.

Meanwhile, the counsel for the victim told DNA that he will oppose the clean chit granted to the accused and is awaiting the report to be submitted before the high court.

"We will decide the future course of action once the police submit the probe report before the court. We have been long demanding a fair probe in the matter and the police have not carried out the same," he said.

Case details

The victim in her complaint had claimed that four unidentified people, wearing masks, had abducted her from Nehrunagar in March in a sports utility vehicle (SUV). Two of them raped her and filmed the act. She alleged that she was again abducted in the same SUV by three of the four accused on the night of June 27 from Maninagar and molested before being released. One of them told her that she was raped at the instance of her boyfriend. Police had booked seven people, including two women and her boyfriend, for abduction and rape.
