Power dispute: ‘Jerk’ in supply sends case back to district forum

The state consumer protection forum sent back a case concerning a dispute over an electricity bill to the district forum as it felt that it was important to analyse the case taking into consideration the rules for ‘jerks’ in electrical connection.

The matter came up before the state forum after the Paschim Gujarat Vij Company Ltd (PGVCL) appealed against an order of the Jamnagar district forum.

The district forum had ruled in favour of New Garment Laundry which had accused the company of not correctly testing his electricity meter and forcing him to pay a higher bill.

The laundry received a bill of Rs 7,842 for the month of Jan-Feb in the year 2009 against an average bill of Rs 2000. The customer complained that the higher bill was on account of a jerk in meter or because of the meter operating faster than the usual rate.

PGVCL on March 29, 2009, replaced the meter and took the old one for a lab test. The test found nothing wrong with the meter. The complainant alleged that the company forced him to pay the higher bill or threatened to disconnect the service.

The complainant said that the company failed to follow the provision of the Electricity Act and did not even bother to refer the matter to the electrical inspector. He further challenged the lab report of the meter and said that he was forced to sign the ‘ok’ report as he was threatened with the service being disconnected.

The consumer had sought that the bill be cancelled and he be paid interest of 18% apart from Rs 5,000 for mental trauma.
