PMFBY: Gujarat High Court directs insurance company to pay for crop damage

The Gujarat High Court has directed an insurance company to pay the dues to a farmer under the Pradhan Mantri Fasal Bima Yojana (PMFBY). 

The high court's direction came after it was brought to the notice of the court that despite a recommendation by district level committee of PMFBY, the insurance company has not bothered to act on it. 

The court has asked the company to act as expeditiously as possible on the order and preferably within a period of four weeks.

The matter pertains to a petition filed by a farmer who alleged that the insurance company was not acting on his insurance claim application. This was despite the fact that his application for insurance claims was forwarded by the district level committee. 

He had further stated that despite having put a claim, the company was not dealing with it and not giving any reason for the delay. The petitioner said that he had paid an insurance premium of Rs 2,801 under the PMFBY for his paddy crop through the SBI. 

The said crop was affected by a disease, as a result of which, the farmer had to suffer a loss of Rs 2 lakh and he filed for a claim through the concerned agency in November 2017. The petitioner had also attached photos of his damaged paddy crop. 

The petition further states that, as per PMFBY, the respondent authorities are required to take immediate steps for payment of insurance amount in case of crop failure or damage. But in this particular case, the farmer did not get any response from the insurance company even after six months. The petition had sought the court's direction that the respondents be directed to take immediate steps with regard to the pending payment.
