PAAS leader Alpesh Kathiriya’s bail in sedition case cancelled

A sessions court in Surat on Tuesday cancelled the bail granted to Patidar Anamat Andolan Samiti’s (PAAS) leader Alpesh Kathiriya in a sedition case after Surat crime branch officials approached the court with a bail cancellation plea citing law and order violation by him.

The cancellation of bail, essentially, means that Kathiriya can be again put behind bars. However, the PAAS leader’s counsel Yashvantsinh Vala said that he will challenge the order before the high court and seek an interim stay in the matter. “I will get a certified copy of the order on Wednesday and we will move the high court against the cancellation of bail and seek a stay. However, in the meantime, the police can arrest him,” Vala said.

Kathiriya was granted bail in the Surat sedition case by the sessions court on December 6, a few days after he was granted bail in the Ahmedabad sedition case. While out on bail, four offences were registered against Kathiriya at Varachha and Sarthana Police Stations on December 28 for entering into a scuffle with traffic cops and hurling abuses at them over towing away of vehicles parked in the no-parking area of a private complex. He was eventually brought to Varachha Police Station, where he continued to abuse the cops, including senior police officials.

The police recorded the same and produced it before the court to get the bail cancelled citing that Kathiriya was violating the bail conditions by disturbing the law and order situation. This led the court to cancel the PAAS leader’s bail.

Interestingly, the Gujarat High Court had granted bail to the PAAS leader in November 2019 in the sedition case filed against him in 2015, by the Ahmedabad crime branch after widespread violence erupted in the state during Hardik Patel’s quota stir. 

However, before he could be released, he was arrested by the Surat crime branch in two cases pending against him in the diamond city—one of them being a sedition case for inciting a youth to  murder policemen and another one for attempted murder. While Kathiriya secured bail in the sedition case on December 3, the court granted him relief in the attempt to murder case on December 6.
