A special SIT Court will hold screening of videos pertaining to the 2002 Naroda Gam riots on Wednesday. The videos were to be originally aired on Monday, but could not be done due to technical difficulties. The videos will help the court ascertain the role of some of the accused. BJP's Maya Kodnani is one of the 82 accused in the case.

The three CDs to be screened include that of Operation Kalank — a sting operation carried out by journalist Ashish Khaitan and aired by a media outlet in 2007. The sting operation on two of the accused, former Bajrang Dal leader Babu Bajrangi and Jaideep Patel, showed them confessing to killings during the 2002 riots.

The court gave a nod for the screening after the prosecution and defence both agreed to it.

Meanwhile, arguing before the court, the prosecution while making its legal submissions to show the conspiracy angle stated that the unlawful assembly of people pointed to common intention on the part of the assembled to carry out violence.

The prosecution also argued against the defence's stand that the mandatory identity parade was not carried out for the accused.

The prosecution said that several judgment of the high court and the Supreme Court had pointed to the fact that identity parade was not mandatory and witnesses confirming the identity of the accused was enough.

About the major contradictions in the account of witnesses, the prosecution argued that the contradictions pointed out were not valid as the incident took place in 2002 and the witnesses were asked to give their testimony in 2009- 10. The prosecution also pointed out that the initial investigation was extremely shoddy, prompting the SC to order a reinvestigation. The prosecution also urged the court to take into consideration the fact that many of the witnesses were either illiterate or had low education and it was their first time standing as a witness in any case.
