Impact fee freed from jantri, drastic cut in charges

Illegal constructions of up to 100 sq m can be regularised by paying maximum of Rs75,000.

The Gujarat state government on Friday announced a sharp reduction in impact fee charges and also simplified the administrative process for regularising lakhs of illegal constructions across the state.

There are an estimated 5 lakh illegal constructions in Ahmedabad and 20 lakh in the state.

Under the new rules, the system of calculating impact fee charges on the basis of the jantri rate has been done away with, and a lump sum amount would be charged depending on the size of the illegal construction, said officials.

The Gujarat state government had earlier come out with the Gujarat Regularisation of Unauthorised Development Bill-2011 to regularise illegal constructions. However, the scheme received very poor response, which was attributed to the high charges and the tedious regularisation process. This forced the government to slash the impact fee rates and simplify the administrative procedure.

“The impact fee rates have been reduced in view of representations received by us from citizens. The rates have been cut by at least 50%. The procedure (for regularizing the illegal constructions) has also been simplified,” urban development minister Nitin Patel said.

According to the new rules, illegal constructions of up to 25 sq m (square metre) which are in use for residential or commercial purposes, can be regularised on payment of a maximum Rs12,500. Earlier, depending on the location, regularizing such a construction would have cost at least Rs30,000 to 40,000.

For illegal constructions measuring between 25 sq m and 50 sq m, the owner would have to pay Rs12,500 for regularizing 25 sq m, and Rs500 per sq m for the remaining. Likewise, constructions measuring 50 sq m to 100 sq m can now be legalized by paying Rs25,000 for 50 sq m, and Rs1,000 per sq m for the remaining construction.

 “Illegal residential or commercial constructions of up to 100 sq m can be legalized by paying a maximum of Rs75,000. This is a charge any poor or middle class family can afford,” said
officials.  In many cases, families run small businesses from their residence itself. Earlier, there was a provision to decide impact fee for both residential and commercial purposes. However, in case 25 per cent or less portion of such construction is used for commercial purpose, the structure would be treated like a residential one for determining the impact fee.  Moreover, till now, shopping centres and other commercial constructions were required to pay double of jantri rates for regularising unauthorised construction. Further, parking deficit of only up to 100 sq m or 25% of parking requirement was to be regularised directly.

Now parking deficit of up to 200 sq m will be regularised and that also by paying only single jantri rates for parking deficit instead of the double of jantri rate.  With the new rules coming into effect, property owners can make applications for regularizing illegal construction without an NOC from any department or the society. Moreover, only owners of high-rise buildings would be required to obtain a structural safety certificate.
