HC seeks Kutch Civil Hosp’s medical report on rape victim

Gujarat High court on Thursday ordered the chief medical officer of Kutch Civil Hospital to conduct the medical test on a pregnant rape victim and file a report by July 13, when the matter has been kept for further hearing.

Prajakta (name changed), a minor and a resident of Kutch, had approached the High Court through her father with a prayer to have the foetus medically terminated. According to her, she was kidnapped and then raped and the accused then dumped her near her residence after her father lodged a complaint.

Petitioner’s advocate Sanjay T Patel submitted that the victim, who is just 15 years old, is physically unfit to deliver the baby and will face adverse health complications by doing so. If she has to deliver the baby, it will bring agony to her and her life will be ruined and she will not be able marry and settle in the future.

He further submitted that on May 15, 2017, when the medical test was first carried out, she was over seven weeks pregnant, which as of now is nearly 14 weeks. While pleading for the medical termination of her pregnancy, advocate requested the court to direct the chief medical officer at Kutch Civil Hospital and the gynaecology department to conduct a test to gauge the victim’s health and the risk involved in the carrying out the termination.

After hearing the petitioner, single bench justice AJ Desai has ordered the chief medical officer at the hospital to conduct the test and submit a report on the foetus length, girl’s health and risk involved in the termination of pregnancy.
