HC rejects plea to stay coop society board meet

Though the new board of directors of Jamnagar Jilla Sahakari Kharid Vechan Sangh were elected in 2015, the board will meet for the first time on Tuesday to elect its chairman and vice-chairman. The reason behind the delay was that the ruling party was short in numbers and government nominees were not appointed.

On Friday, single bench justice Bela Trivedi refused to stay the first meeting and election of chairman and vice-chairman scheduled for Tuesday. One of the elected members Pratapsinh Jadeja had challenged the meeting on the ground that one of the directors from Bhanvad Sahakari Mandli is co-opted (nominated) and not elected.

Only elected members can be nominated by affiliated cooperative society. This action is illegal and so the court should stay the meeting and election. The court then issued notice to the respondent parties and the matter is kept for further hearing on October 11.

Of the 17 board of directors, 14 are elected and rest three are nominated by the state government. Vehemently opposing the prayer, assistant government pleader Venugopal Patel submitted that for last two years, the first meeting to elect the chairman and vice-chairman has not taken place.

The state had appointed administration so that Sangh's administration functions normally and affiliated members' co-operative societies don't suffer. The appointment of administrator was a stopgap arrangement and it cannot be permanent. Now, excluding one, when all directors are available, the first meeting to elect chairman and vice-chairman should be allowed to take place.

Petitioner Pratapsinh Jadeja's contention is that Bhanvad Sahakari Mandli's nomination is allowed on the board just because he belongs to the ruling party. Jadeja stated that he is allowed to vote by the district registrar cooperative just because he is from ruling party.
