HC allows 15-yr-old rape victim to abort foetus

The high court on Thursday granted permission to a minor rape victim for medical termination of her pregnancy. The court took into account her age and physical health while passing the order. It has directed Kutch-Bhuj’s GK General Hospital authorities to carry out pregnancy termination at the earliest, under the supervision of specialized gynaecologist and other doctors.

Single bench justice AJ Desai while allowing the prayer of rape victim Prajakta (name changed) observed, “According to the medical report, if the pregnancy is allowed to continue, there is risk to the life of victim who is 15 years and a few months old. The foetus is 19 weeks and one day. There is risk to victim’s physical and mental health as she is not mature to carry the pregnancy. At this age she may not be ready to become a mother.”

Prajakta had approached the HC seeking permission to end the pregnancy that was conceived after repeated rape. On July 6, the high court took up her prayer. The petitioner’s advocates Nisarg Shah and Sanjiv Patel had submitted after her father lodged complaint with the local police station, accused had dumped her near the residence. She was kidnapped by the accused in February. She was found in May this year after which she underwent medical tests which revealed that she was six weeks pregnant.
