Gujarat: Who ordered fake encounters, victims' kin question

They plan to move the SC in this connection

Relatives of victims of three fake encounters in Gujarat have sought that the Supreme Court should direct the Justice Bedi Committee to further investigate to know who ordered the fake encounters.

Relatives of Samir Khan, Haji Ismail and Kasam Jafar said that while they welcome the report which had said that the three encounters were fake, they also wanted a probe into the role of the then Gujarat chief minister Narendra Modi, home minister Amit Shah and other top police officers. They plan to move the SC in this connection.

Advocate Anand Yagnik, who is helping the three families, said that the report has clearly stated that the three encounters were fake and the policemen involved need to be prosecuted in all the three incidents. "However, it stays silent on who ordered the shooting and how it could have happened without the knowledge of top cops and the home minister," said Yagnik.

"The kin of the victims want that the larger role of Amit Shah, top cops like Abhay Chudasama and others should be investigated to determine whether they are innocent or guilty," Yagnik added.

Citing an example, he said, Haji Ismail, who was killed in an encounter near Umargam, was picked up from Lonavala in front of his family by Chudasama. "How can it happen that a man was picked up alive and there are witnesses to it, yet he ends up dead in an encounter? How is it that lower-level officers get named, but the top cop who picked him is never mentioned anywhere?" he said.

Yagnik added that it is imperative for the relatives of the victims to find out not just who killed the three men and who gave the orders for the killing.

The Supreme Court had in 2012 set up a monitoring committee, headed by retired SC judge Justice Bedi, to overlook investigation by the Gujarat Special Task Force into several fake encounters that happened between 2002 and 2006 in the state.

The committee was formed following a petition by Javed Akhtar seeking a CBI probe into the fake encounters.
