Gujarat High Court summons police officials over custodial death

Brother of the victim, who is also the complaint in the case, has contended before the court that the officials probing the case are not doing their job responsibly

The Gujarat High Court on Friday issued a notice to the state government as well as police authorities probing the infamous custodial death of a 35-year-old man in old Bopal police station after a petition was filed by the victim's brother alleging "shoddy probe" in the matter. The single judge bench of Justice Sonia Gokani issued the notice directing the state, as well as the police administration, to file their response within December 12.

Notably, the brother of the victim, who is also the complaint in the case, has contended before the court that the officials probing the case are not doing their job responsibly. He has also demanded a CID probe in the matter. Following the submission, the court also summoned two police officials probing the matter, including the deputy superintendent of police KT Kamaria, and directed them to remain present before the court during the next hearing on Wednesday.

Counsel for the petitioner Hriday Buch told DNA that the petitioner wants that those responsible for the custodial death should be prosecuted and the probe should be handed over to CID to ensure fairness and transparency. So far, only three policemen deployed with the special operations group (SOG) and local crime branch (LCB) have been arrested by the special investigation team (SIT) headed by Kamaria, while the others are still free, Buch said.

As per the case details, the victim, Surubha Jhala, was an employee of a courier company and died in a police custody on October 15, after he was held for questioning by the SOG and LCB in connection with a gold theft case of Rs 2.5 crore. The victim, a resident of Naroda, died in the old Bopal police station, where he was kept on Sunday night. After facing severe criticism, a SIT was formed under Kamaria to probe the matter and three personnel of SOG and LCB have been arrested so far in the case.
