Gujarat High Court orders AUDA to take back 'public' land from Ahmedabad International School

The court also directed the school administration to inform the parents of children studying there that the school lacks a proper parking and playground.

The Gujarat High Court on Tuesday directed the Ahmedabad Urban Development Authority (AUDA) and Ahmedabad Municipal Corporation (AMC) to immediately take back the possession of a land located in Bodakdev given to Ahmedabad International School (AIS). The direction came from the division bench of Acting Chief Justice AS Dave and Justice Biren Vaishnav in a public interest litigation (PIL) questioning the allotment of land to the school by AUDA, which is originally meant for a public garden.

The court also directed the school administration to inform the parents of children studying there that the school lacks a proper parking and playground. The division bench also directed the authorities to develop the land for the purpose for which it was reserved.

The petitioners, through the PIL, had submitted to the court that AUDA had given its land adjacent to AIS to be used by the school as a playground and the school later converted it into a parking lot and had prevented general public from accessing the plot. The state had then clarified that the land allotment was as per rules and that the school was to allow access to public at all times except for when the school is functioning. The school had then submitted that it would not use the ground as a parking lot.

Thereafter, the petitioners again approached the high court stating that it had been two years since the petition was filed and the case needs to be disposed off and the public should get their garden. They had further stated that the school continued to use the ground as a parking lot even as the public waited for a garden to take shape there.

Following this, the court then directed the state government to clarify its stand in the matter. It also remarked that the land meant for public use cannot be given to a private organisation.
