Gujarat High Court disposes PIL on acid and poison sale

The petitioners sought the court's intervention in the effective implementation of the rules so as to put an end to acid attacks.

The Gujarat High Court has dismissed a public interest litigation (PIL) filed by Gujarat Scientific Association seeking effective implementation of the rules related to the sale and use of acids and poisons in the state. The division bench of Acting Chief Justice AS Dave and Justice Biren Vaishnav dismissed the PIL for being bereft of any 'public interest'.

The petitioners sought the court's intervention in the effective implementation of the rules so as to put an end to acid attacks.

However, in order to drive home their point, the association claimed that the government has given several exceptions to the wholesalers of acids and poisons from the applicability of the Poison Possession and Sale Rules under the Poisons Act, 1919, notified in November 2014.

The association had also contended that the objections and suggestions given by the association during drafting of the rules were also not entertained by state government.

The said rules were notified after a direction from the Supreme Court in 2013 to regulate sale and use of acids in view of the rampant acid attack cases reported in the country.

In a bid to prove the state government's partial treatment, the association had also submitted to the court that retailers are hauled up every time any acid attack takes place despite the poison or acid having been sold by the dealers engaged in the wholesale business.

Despite the submissions made by the association, the court ruled, "On perusal of the record, what appears is that the grievance ventilated by the retailers against the wholesalers while framing the rules, an individual interest is involved in filing the petition, much less of wider public interest. We do not find any public interest in the request by the petitioners and the petition is disposed off."
