Gujarat HC reserves order in case challenging hiring of DC

The Gujarat High Court on Wednesday reserved its order on a petition challenging the Ahmedabad Municipal Corporation’s (AMC) recruitment process for the post of Deputy Commissioner. The petition was filed by one Naresh Rajput and three others. The case was heard by the second division bench of Justice MR Shah and Justice Biren Vaishnav

The petitioners had approached the court seeking its directive for the civic body to lay down proper rules regarding the process for the appointment to the post of Deputy Commissioner. The petitioners had argued that in 1995 the Commissioner at the time had introduced quota for direct recruitment and promotion of internal staff. According to the rules, 67% of the total vacancy was to be filled through direct appointment and the remaining 33% seats was to be given to the internal staff. However, according to the petition, this meant injustice to those working for the corporation for a long period of time and can be promoted based on their experience and performance.

The petition was filed in 2013 after the corporation issued an advertisement inviting applications for the post of Deputy Commissioner on September 04, 2012. They had challenged the advertisement citing that a similar advertisement was published a few months before that seeking applications, following which written tests were held. However, even before the written test results were made public, the civic body went ahead and issued another advertisement inviting applications for the same post. The petitioners told the court that the people who had appeared for the written test were not even informed about the second advertisement.

The case was first heard by a single bench court on February 08, 2013. The judge had then ordered to maintain status quo in connection with the September 2012 advertisement. The court had, however, told the corporation that the selection and recruitment procedure to the post through the advertisement in question would be governed by the final outcome of the petition.
