Gujarat governor OP Kohli refers two Bills for Presidential assent

Gujarat governor OP Kohli on Thursday approved 11 out of 14 Bills passed by Gujarat Assembly in the latest Budget session of the State Assembly. Three bills have been referred to the President for his assent. The three bills which are in the concurrent list of the Acts of the central government have been sent to the Home Ministry for approval from the President.

The three bills sent for approval are: the Gujarat SC/ST and OBC (Regulation of Issuance of and Verification of Caste Certificates) Bill, Registration (Gujarat Amendment) Bill and the Gujarat Prevention of Fragmentation and Consolidation of Holdings (Amendment) Bill.

The SC/ST and OBC Bill suggests criminal proceedings against persons reaping benefit of caste reservation by producing fake certificates. The said bill seeks to create a new Act to curb the practice of producing fake caste certificates. As per the provisions of this proposed legislation, those found guilty of producing fake caste certificate either for government jobs, or for securing admissions or for contesting local bodies polls, would face a jail term of up to three years.

The bill amending the Registration Act seeks to mandates all notorised power of attorney documents to be registered by authority to avoid forgery. The amendment to the Prevention of Fragmentation and Consolidation of Holding Bill was aimed at making the process of land deals easier. It seeks to amend the state Act formed in 1947, to eliminate discrepancies in the imposition of fine on land owners for the transfer or partition of land.

Among the bills approved on Thursday, one was one related to the establishment of the Road Safety Authority, while others pertain to setting up of new private universities and exempting restaurants from seeking registration certificate from police. Under the establishment of new private university bills, apart from two state-run universities, Gujarat will get new private universities.

Under the Gujarat Road Safety Authority Bill, the proposed body would be the lead agency for undertaking the work of road safety with the coordination of separate government departments, NGOs, and volunteers, in a bid to bring down the number of fatalities in road accidents.

Sources from the secretariat of the Gujarat Assembly said, "Since all these three bills are related to Central Acts or to the provisions of the Constitution, they have been sent to the President for his approval by the Governor," said the official. Rest of the bills have been forwarded to the concerned departments so that the official gazette can be published announcing the Act coming into force."
