BMW hit and-run case: Wife gets bail, Vismay Shah will have to wait

The Gujarat High Court on Wednesday granted bail to BMW hit and-run convict Vismay Shah’s newly-wed wife and four others who were arrested with Vismay in an inebriated condition from a liquor party at a farmhouse in Adalaj on December 26. The court, however, refused to grant bail to Vismay, but extended his temporary bail to January 11, when his bail plea will be taken up for hearing.

All the six persons are out on temporary bail granted by the high court on January 4, which was valid till Wednesday. Apart from the relief provided to the five accused, the court also relaxed their bail condition and restricted their movement within the country, which was earlier confined to just Ahmedabad. It clarified that the five accused should submit their passport to the lower court and shall not leave the country without prior permission of the sessions court. The bail was granted after the state government counsel clarified that the five accused have no criminal antecedents.

While taking up Vismay’s bail plea, the state government pointed out the criminal antecedents of Vismay to the bench. The court, thereafter, asked his counsel to file a reply on the status of Vismay’s appeal against his conviction in the hit-and-run case. It also asked the petitioner to clarify on his criminal antecedents and past conduct. Also, the court directed the state government to file a reply in the matter clarifying its stand on the issue.

The senior counsels, appearing for the accused, had earlier argued that the state government is drawing a sadistic pleasure in the case and in consumption matters, invariably bail is granted. The advocates had then submitted that the accused are not charged with bootlegging and the sections leveled are not grave in nature. It was further argued that when courts can grant bail to an accused caught with Rs 30 lakh worth of liquor, the petitioners should also get bail.
