Bath fitting company asked to compensate Rs 67K for defective products

The Gujarat State Consumer Dispute and Redressal Commission (GSCDRC) has asked a bath fitting manufacturer and supplier to compensate a consumer for defective bath fittings.

Ahmedabad's Ashwin Patel appealed to the commission saying that the body jet bath supplied to him was defective and he wanted full compensation for the parts and the fitting charges as well.

Commission's principal bench of justice MD Shah, member Jyoti P Jani and member Usha Jani, while partially allowing the appeal, has directed the Jaquar and Company Pvt Ltd to repay Rs 17,000 for the body jet fitting and Rs 50,000 towards repairing and installing a new bathroom fitting and tiles work with a 7.5 percent interest.

"The way the company's technician had filled some holes in the body jet fitting to ensure that consumer gets a shower with pressure shows that it was defective. On the other hand, the consumer had installed a high-pressure pump to ensure that the high-quality body jet bathroom fitting works efficiently. Even after that, it did not work."

It further said, "Just by claiming that the water reaches six feet is not enough, all 140 holes were not working, only 80 holes were working, which the consumer has established through a video record. We have it and found many loopholes from the company's side."

The commission, while interfering with the forum order observed, there is an error on the part of the forum in the conclusion that because of low water pressure in the bathroom, the body jet fitting is not working. IT said the forum had failed to substantiate its conclusion with supportive evidence on record.

The appellant had bought the bathroom fitting from the company's dealer worth Rs 1 lakh. On the advice of company's official technician, these fittings were installed. As the complainant was dissatisfied, he complained to the dealer. A technician visited and his conclusion was that the fitting was inappropriate.

Finally, the consumer changed the bath fitting and had to break away the entire bathroom wall for a new fitting for Rs 50,000 over and above the initial expenses. In the complaint, he pleaded for over and above these expenses for Rs 40,000 as compensation for mental harassment.

THE ORDER
