The complaint of infringement of trademark against organisers of the Amdavad Shopping Festival, 2019 has been withdrawn, the organisers claimed on Monday that marked the last day of the 12-day-long festival. They claimed that after being assured that the shopping festival was a not-for-profit initiative, the petitioner — 3rd Eye Event & Advertising withdrew the complaint.
In a letter submitted to the court, the company said, “Pursuant to the amicable settlement arrived at between the parties, the plaintiff hereby agrees to withdraw the present suit unconditionally.”
In a press statement, Jayendra Tanna, president of the federation said the dispute has been sorted out amicably. Accordingly, Kiran Vora, vice-president of the federation brought to Desai’s notice that the ASF is a ‘not-for-profit’ exercise to benefit small retailers and that there are no commercial motives. “Vishal Desai, whos had filed the suit, has withdrawn the case unconditionally,” stated Tanna.
3rd Eye Event & Advertising had last week filed a case in the commercial court in Ahmedabad alleging infringement of its trademark by Industrial Extension Bureau (iNDEXTb), Ahmedabad Municipal Corporation (AMC) and Vibrant Gujarat Shopping Festival Organising Federation. 3rd Eye had said in the complaint that it had developed the concept — Ahmedabad Shopping Festival on February 1, 2015 and has been using the term openly and extensively ever since.
It had also said that at the fag end of the year 2014, it had made a presentation to several bureaucrats in the Gujarat government about the possibility of conducting and organizing the shopping festival and generating revenue for the government body.
