Four years ago, a citizen of Ahmedabad had decided to sue a Reliance Retail store in Paldi for charging an extra Rs 2 over the marked MRP on a packet of Rajgira flour. However, the aggrieved customer lost a protracted battle in the district consumer court after the defendant’s lawyer proved that there was insufficient evidence in the case.

The case dates back to 2014, when Saroj Patel was furious as the store charged Rs 52 for a flour packet which had a marked minimum retail price of Rs 50. Determined to fight for her rights, Patel consulted with the Consumer Education and Research Centre before approaching the district consumer court. Accusing the store of unfair trade practices, Patel sought the return of the additional Rs 2 with a 12 per cent interest from May 18, 2014 onward, the day she bought the packet of flour. She also sought a compensation of Rs 25,000 for mental agony and Rs 10,000 for the expenses incurred in the legal battle.

Disposing of the matter, the consumer court observed that the store had given a Rs 1.04 discount on the product (as evident from the bill), bringing down the overcharging to a meager 96 paise. Additionally, the case was dismissed on grounds that the customer failed to provide ample evidence.

The defendant’s lawyer also argued that the store wouldn’t put its goodwill at risk for just Rs 2.

Furthermore, the lawyer said that the complainant never approached the store for redressal, even though she was aware of the overcharging while buying the product.

“Had she brought it to the notice of the store at the time of the incident, it would have been remedied,” the defendant’s lawyer said.
