HC questions doc for issuing certificate

Accused Vinu Patel had sought temporary bail citing wife's surgery.

The Gujarat high court has sought an explanation from a city-based cancer surgeon for giving a certificate to a woman whose husband had sought temporary bail in the Amit Kapasiyawala murder and land grabbing case in Surat.

Accused Vinu Patel had sought temporary bail by claiming that his wife was suffering from fibrocystic lesions in the breasts and sector mastectomy was necessary. Patel submitted a certificate issued by Dr Jayvirsinh Jhala, who runs the Histopathology and Cytology Diagnostic Centre.

Justice AS Dave had ordered the sending of the medical papers to Gujarat Cancer and Research Institute for a second opinion. The government institute concluded that the microscopic examination and histopathology reports could not be confirmed as slides/blocks were not provided (by the doctor); there was no suspicious area detected in either of the breasts which may warrant incisional biopsy or sector mastectomy.

Dr Jhala, meanwhile, told the police that the certificate was issued based on the biopsy report and sonography. No case papers of her treatment were available in his hospital because she had come as an outdoor patient and only for consultation, he said.

In its order, the court said, “A case is made out to seek explanation from Dr Jhala for issuance of certificate and availability of the slides/blocks of Histopathology reports on the basis of which diagnosis were recommended and surgery was advised.”
